Welcome to Country Canvas Studio. The CCS website (the “Site”) is comprised of various web pages operated by CCS and is presented to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of www.countrycanvasstudio.com constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference.

Country Canvas Studio at www.countrycanvasstudio.com is an Ecommerce Site. The Site’s purpose is to promote and make available for purchase to the public original art and other handcrafted, handmade items. Examples include original paintings, drawings and reproduction prints of original paintings and drawings and other items created, crafted, designed, developed and processed by CCS. Some sublimation, svg and design production elements may originate from other designers to be used in products designed, developed and processed by CCS and utilized under production license agreements with said developers/designers. Digital crochet patterns offered on CCS website are original patterns that have been designed and developed by CCS. Any likeness to or similarities to another crochet pattern are incidental. Items that are solely designed and developed by CCS with state that they are original CCS creations and/or designs. CCS retains the copyright to and the right to reproduce all items sold on the Site unless other arrangements are explicitly requested, agreed to and provided to buyer.

Privacy

Country Canvas Studio does not knowingly collect personal information online from children under the age of 13. The Site and our Services are intended for use by individuals aged 13 and older.

If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information and terminate the related account.

Photo and Image Disclaimer
Product photos and lifestyle images on https://www.countrycanvasstudio.com (the “Site”) are for illustrative purposes only. While we make reasonable efforts to display colors, finishes, scale, and details accurately, the actual appearance of items may vary due to lighting conditions, handcrafted variation, monitor or device settings, and natural differences in materials. Such variations are not defects.
Art created by CCS is original handcrafted products unless the item specifically states that it is a reproduction. In original art pieces images and likenesses will not be exact replicas.
User generated photos, reviews, or social media content displayed on the Site may feature items from past collections, custom work, or styling accessories not included with your purchase. Unless expressly stated in the product description, frames, props, and accessories are not included.
By tagging or submitting photos to Country Canvas Studio (including via social media hashtags identified by us, email submissions, or uploads), you grant Country Canvas Studio a non exclusive, worldwide, royalty free license to use, reproduce, display, and share that content on the Site, in emails, and on our social channels, for marketing and informational purposes, subject to our Privacy Policy. You represent that you own or have the necessary rights to any content you submit and that our use will not infringe third party rights.
If you are a rights holder and believe an image on the Site infringes your rights or should be removed, please contact us at s.bramlett@countrycanvasstudio.com with the URL of the image and proof of ownership. We will review and respond promptly.

No Unlawful or Prohibited Use/Intellectual Property
You are granted non-exclusive, non-transferable, revocable license to access and use www.countrycanvasstudio.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to CCS that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. CCS content is not for resale. International Users
The Service is controlled, operated and administered by CCS from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the CCS Content accessed through www.countrycanvasstudio.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification
You agree to indemnify, defend and hold harmless CCS, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities, expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to the Site or services, any use postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulation. CCS reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with CCS in asserting any available defenses.

Liability Disclaimer
The information, software, products, and services included in or available through the Site may include inaccuracies or typographical errors. Changes are periodically added to the information herein. Country Canvas Studio and or it suppliers may make improvements and/or changes in the Site at any time.
Country Canvas Studio and or it’s suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services and related graphics contained on the Site for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services and related graphics are provided “As Is” without warranty or condition of any kin. Country Canvas Studio and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement.
To the maximum extent permitted by applicable law in no event shall Country Canvas Studio and/or it’s suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Site, with the delay or inability to use the Site or related services, the provision of or failure to provide services, or for any information, software products, services and related graphics obtained through the site, or otherwise arising out of the use of the Site, whether based on contract, tort, negligence, strict liability or damages because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the Site, or with any of these Terms of Use, your sole and exclusive remedy is to discontinue using the Site.

Termination/Access Restriction
CCS reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Texas and you hereby consent to the exclusive jurisdiction and venue of courts in Texas in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provision of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and CCS as a result of this agreement or use of the Site. CCS’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of CCS’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by CCS with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and CCS with respect to the Site and it superseded all prior or contemporaneous communication and proposals, whether electronic, oral or written, between the use and CCS with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceeding based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express with to the parties that this agreement and all related document be written in English.

Payment Processing with Square
CCS uses Square, Inc. (“Square”) to process payments for purchases made through the website www.countrycanvasstudio.com. By submitting a payment, you authorize us and Square to process and store your payment information and complete the transaction.
Your payment information is provided directly to Square and is handled in accordance with Square’s terms, privacy policy, and security practices. We do not control and are not responsible for Square’s data handling or security measures. We do not store full card numbers or CVV codes on our systems. Square may store and use your payment details as necessary to process transactions, handle refunds, and prevent fraud.
By using Square to make a payment, you agree to comply with Square’s applicable terms and policies, and you consent to Square’s collection, use, processing, and retention of your information for payment processing and related purposes (including fraud monitoring and compliance).
We may replace or add payment processors at any time. If we do, we will update this section and identify the applicable processor(s).

CCS website offers a wide range of payment options through Square Inc. Square Inc. accepts credit and debit cards(Visa, Mastercard, American Express, Discover, JCB, UnionPay), digital wallets(Apple Pay, Google Pay, Samsung Pay), and other methods like CashApp Pay.
CCS does not currently accept ACH bank transfers, wire transfers or Afterpay.
CCS can accept other forms of payment including cash for in-persons sales, vendor markets or on-site events. Cash and other forms of payment are only available for in person sales.
CCS does not accept any payment method not provided to consumers by Square Inc. for online payment processing through the CCS website.
All fees, charges, refunds, and reversals are subject to our policies and to Square’s policies. If a payment is declined, reversed, or charged back, you remain responsible for any outstanding amounts and any associated fees.
To the maximum extent permitted by law, we are not liable for acts or omissions of Square. Our limitation of liability and disclaimer of warranties apply to payment processing services provided by Square.

Changes to the Terms and Conditions Policy
We reserve the right to update these Terms and our policies (including our Privacy Policy, Shipping Policy, Terms and Conditions Policy and Cancellation, Return and Refund Policy) from time to time. If we make material changes, we will post the updated version on https://www.countrycanvasstudio.com and update the “Effective Date” at the top. We may also provide additional notice (such as by email or a banner on the Site) where required by law.
Unless otherwise stated, changes take effect when posted. Your continued use of the Site or purchase of products after the effective date of any changes constitutes your acceptance of the updated Terms or policy. If you do not agree to the changes, you should stop using the Site and, if applicable, cancel any open orders that have not yet shipped.
